§1 GENERAL SUBJECT

IKON Gastronomia Kft. is the operator of the online delivery service www.noki-etterem.hu and thus a portal for ordering food via the Internet or telephone, i.e. the recording and processing of orders and delivery of food and beverages and related goods and services between the customer ("orderer") and the restaurant ("supplier"). The contents and services on www.noki-etterem.hu are self-explanatory in their nature and can be accessed on a daily basis.

§ 2 CONCLUSION OF CONTRACT, MINIMUM ORDER VALUES

The goods and services presented on the website by the provider do not constitute a binding offer. The customer's order by telephone, email or online represents an offer to conclude a corresponding purchase and delivery contract. The provider can accept the order by sending a confirmation e-mail or in the case of a phone order, by verbal confirmation of the order. For an order a minimum order value must be kept. We deliver exclusively in Debrecen. We ask for your understanding that not all dishes and drinks offered are always available. The availability of the dishes is subject to seasonal fluctuations. If the dishes designated by the customer in the order are not available or cannot be delivered on time, the supplier will refrain from sending a confirmation e-mail / from accepting the contract and will inform the customer immediately. 

a) Order via the menu of the website (online)

You can put the dishes and drinks into a virtual shopping cart at www.noki-etterem.hu. By clicking on the field "Checkout" you initiate the ordering process. You will be asked to enter your data. After you have checked your data, you can forward your order to the supplier by clicking on the corresponding field. The forwarded order is merely an offer to the provider. Your order will be accepted by a confirmation e-mail. A contract for the delivery of the products is only concluded after the confirmation e-mail.

b) Order by email

If you place your order by email, we will send you a confirmation email. If the orderer does not receive a further notification within 15 minutes after receipt of the confirmation e-mail about the untimely availability or deliverability of the ordered food, the offer of the orderer is considered accepted (acceptance of the contract). The confirmation e-mail then documents the conclusion of a sales contract and shows the exact content of your order. 

c) Order by telephone

If you place your order by phone, we will take your order and the billing and delivery data first. The summary of the order and the following verbal confirmation represents the acceptance of the contract. If the customer is notified by e-mail, he will also receive a confirmation e-mail which documents the conclusion of a sales contract and the exact content of your order. 

d) A right of withdrawal from the contract does not exist for the customer as a matter of principle, since goods which have been specially made to his request and are perishable are delivered.

§3 DELIVERY AND DELIVERY AREA

We only deliver within Debrecen. The delivery is made to the delivery address indicated by the customer or selected in the profile. Please make sure that you can be reached at the telephone number provided before delivery. Please make sure that the delivery person has free access to your front door.

§ 4 DURATION OF DELIVERY, DELIVERY TIMES

Delivery times will be indicated when ordering. The delivery time depends, among other things, on traffic, weather and incoming orders. Basically your order should leave our house within 10-20 minutes. The estimated delivery time is shown when you place your order. This is a non-binding estimate, which can effectively vary due to traffic, weather, capacity utilization, etc.

§ 5 DELAYS

Please call us in case of a delay so that our driver is informed accordingly. Telephone +36 30 555 7766 This rule does not apply in cases of force majeure or if the cause of the delay is attributable to the customer.

§ 6 PAYMENT

The payment of the order is made upon delivery on site in cash or by card to the deliverer - train and train against delivery of the ordered and confirmed goods.

§ 7 CONSUMPTION AND HYGIENE

All dishes are fresh and intended for immediate consumption. The Delivery Service excludes legal liability for food not consumed immediately.

§ 8 WARRANTY

With all courts from our shop there are legal warranty rights.

§ 10 PRIVACY AND DATA PROTECTION

We use your inventory data exclusively for processing your order. All customer data is stored and processed by us in accordance with the relevant provisions of the Hungarian Acts. By submitting the order, the customer gives his express consent to the knowledge of the data necessary for the fulfillment of the order by the service provider, to the data management by the service provider and to the use of this data in order to fulfill the contract. You have the right to free information, correction, blocking and deletion of your stored data at any time. In this case please contact us by e-mail. We will not pass on your personal data including your home address and e-mail address to third parties without your explicit and at any time revocable consent. Excluded from this are our service partners, who need the transmission of data for order processing (e.g. sales tools, the shipping company assigned with the delivery and the credit institute assigned with the payment processing). In these cases, however, the scope of the transmitted data is limited to the necessary minimum. We use technical and organizational security measures to protect your data administered by us against accidental or intentional manipulation, loss, destruction or access by unauthorized persons.
